How Long Do You Have to File a Construction Accident Claim in New York?

After a construction accident in New York, you must first notify your employer of your injuries within 30 days of the accident to be eligible for workers’ compensation. Then, you must file a claim with the New York State Workers’ Compensation Board within two years to receive compensation for medical care and lost wages.

If a third party is responsible for your injuries and your plan to file a lawsuit, your case is subject to New York’s personal injury statute of limitations, which gives you three years to file. In the case of a wrongful death, family members of the victim have just two years to file. If your injury involved a government agency, you must file a Notice of Claim within 90 days of the incident and a personal injury lawsuit within 1 year and 90 days.

What Compensation Can You Recover After a Freeport Construction Accident?

While workers’ compensation benefits may cover medical expenses and some lost wages after a construction accident, they generally don’t compensate for all of the resulting losses. However, if someone other than your employer is responsible for your accident, you may have grounds to file a personal injury claim.

In a third-party lawsuit, you can pursue additional damages for lost wages, pain and suffering, emotional distress, loss of enjoyment of life, disability, and more.

The value of your Freeport construction accident claim depends on the nature and severity of your injuries, who was at fault, the strength of the available evidence, and the applicable insurance coverage.

MTS Injury Lawyers will assess the full extent of your losses, determine your options for pursuing justice, and develop a legal strategy tailored to your needs. We’ll handle all the legal details and do the hard work to pursue maximum compensation for you, so you can focus on your recovery.

Common Causes of Construction Accidents in Freeport

Many construction accidents in Freeport are avoidable. Often, they occur because contractors, site supervisors, and property owners fail to follow basic safety requirements and properly protect workers on the job.

Some of the most common causes of Freeport construction accidents include:

  • Failure to provide proper fall protection
  • Unsafe scaffolding, ladders, and elevated work areas
  • Lack of jobsite supervision and safety enforcement
  • Improper training or unqualified workers operating equipment
  • Defective equipment or poor maintenance
  • Violations of New York labor law and OSHA safety standards

New York has robust labor laws designed to protect workers on construction sites. New York Labor Law 200 requires that job site owners and contractors provide reasonable protection for workers.

New York Labor Law 240, also known as “the scaffold law,” sets regulations for the use of scaffolding on New York construction sites to ensure worker safety. Meanwhile, New York Labor Law 241 requires that construction and demolition sites comply with requirements for worker and bystander safety.

Frequently Asked Questions About Freeport Construction Accident Claims

Can I Sue if I Am Already Receiving Workers’ Compensation?

Generally, you cannot sue your employer if you are already receiving workers’ compensation. However, if a third party, such as a contractor or equipment manufacturer, has contributed to your accident, you may be able to file a lawsuit against them for further compensation.

What If I Was Partially at Fault for My Construction Accident?

New York has a no-fault workers’ compensation system, so you are entitled to coverage for medical bills and lost wages no matter who caused the accident. There are some exceptions, such as intoxication and intentional harm, that may lead to the denial of your claim. However, sharing fault for an accident can affect a lawsuit against any third parties. In a third-party lawsuit, your compensation will be reduced in proportion to your share at the fault. Speak with an attorney as soon as possible to learn your options.

Will My Construction Accident Case Go to Court?

Most construction accident claims do not go to court. Workers’ compensation claims may go to a hearing if the insurer has denied the claim or the amount of benefits is disputed. Meanwhile, most third-party lawsuits settle out of court. However, if no settlement can be reached, your case may proceed to a jury trial.
